In 1927, Burton was elected to the Cleveland City Council, where he served for five years. He was then elected to the Ohio state senate in 1935, where he served until 1940. Burton's political career reached new heights in 1940 when he was elected to the United States Senate. Burton served in the Senate from 1941 to 1945. While in the Senate, he focused on civil rights issues and introduced the Anti-Poll Tax Bill, which abolished the poll tax, which had been used to disenfranchise African American voters in the South.

In 1945, President Harry S. Truman appointed Burton as a judge on the United States Court of Appeals for the District of Columbia Circuit. He served on the court for eight years before being appointed to the United States Supreme Court by President Dwight D. Eisenhower in 1949. Burton served on the Supreme Court for 13 years, until his retirement in 1960. Throughout his political career, Burton was known for his commitment to civil rights, and his legacy continues to inspire advocates for justice and equality today.
